The ninth circuit court has upheld a prohibition on sending national guard in Portland, Oregon, following a latest legal decision.

Judicial Panel Concurs to Reconsider Legal Matter

The ninth circuit court of appeals ruled on Tuesday that it would reexamine the case concerning the president’s authority with an expanded group of 11 judges. The court also vacated a previous ruling from a three-judge panel that had sided with the administration.

Ongoing Dispute Over Troop Deployment

This legal directive represents the most recent turn in a protracted legal battle over whether the former president has the authority and justification to deploy state military units in Portland. Approximately 200 federalized guard members have been in limbo since the end of September when the mobilization attempt was started in response to months of protests.

Differing Viewpoints

The administration has argued that federal officials at the immigration center in south Portland were under attack, while local authorities assert that local officers have control of the situation.

In defiance of descriptions of Portland as “war ravaged”, residents have been posting footage of scenic paths and a vibrant culinary culture, and organizing events such as an protest bicycle event against the increased military presence.

Court Proceedings

The Tuesday ruling came after a federal judge in Portland enacted two temporary restraining orders this period – one blocking the federal control of the Oregon national guard, and another stopping the deployment of any military personnel in Oregon, after attempts to evade the initial injunction by mobilizing troops from California.

On Monday, the appeals court had put the first ruling on hold – permitting command of 200 Oregon national guard – but the second ruling stayed effective, blocking the physical sending of the forces.

Full Panel Consideration

The Tuesday decision means the matter will be heard by the full court – with both rulings under consideration together – by a group of eleven justices.

“This ruling demonstrates that facts are important and that the judicial system are striving to hold this administration accountable. The constitution limits the president’s power, and local populations cannot be treated as a training ground for unchecked federal authority,” stated the legal representative in a official comment.

“The judicial body is sending a definite signal: the president cannot send the military into American urban areas without cause. We will continue defending Oregon’s laws, principles, and sovereignty as this legal proceeding moves forward and our fight continues in the courts.”
